Terms and Conditions for Nutritionally Well (AML Fit LLC)

Welcome to Nutritionally Well (“the Company”), operated under AML Fit LLC. These Terms & Conditions (“Terms”)
govern your use of the Company’s website, services, educational content, and any related offerings (“Services”).
By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, please
discontinue use of the Services immediately.

1. GENERAL TERMS
a. Eligibility
You must be at least 18 years old to use or purchase the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
b. Personal Responsibility
You acknowledge that your decisions to engage with the Services, including participation in wellness or nutrition programs, the application of recommendations, or the use of any information provided, are voluntary and entirely your responsibility. You assume full responsibility for any outcomes resulting from the use of the Services.
c. Modification of Terms
The Company reserves the right to modify, update, or revise these Terms at any time without prior notice. Continued use of the Services after changes are made constitutes acceptance of the revised Terms.

2. DESCRIPTION OF SERVICES
a. Scope of Services
Nutritionally Well provides wellness and nutrition-related services, which may include but are not limited to: functional and integrative health and nutrition education, strength & conditioning support, lifestyle and behavior coaching, functional laboratory test interpretation for educational and wellness purposes only, online programs, courses, workshops, and digital resources, blog content, guides, and other informational materials.
b. Accuracy of Information
While the Company strives to provide evidence-based and up-to-date information, Nutritionally Well does not guarantee the accuracy, completeness, or reliability of any information provided. You understand and agree that the use of any information obtained through the Services is at your own risk.
c. Third-Party Content & Links
The Services may include links to third-party websites, content, or products. These external sites are not owned or controlled by the Company. The Company does not endorse and is not responsible or liable for third-party content, services, or actions. Your use of third-party resources is at your sole discretion and risk.

3. PROFESSIONAL & MEDICAL DISCLAIMERS
a. Credentials & Scope of Practice Disclosure
The practitioner(s) behind Nutritionally Well is a Certified Nutrition Specialist® (CNS®), credentialed through the Board for Certification of Nutrition Specialists (BCNS) and recognized by the American Nutrition Association (ANA). The CNS credential does not constitute licensure in New York State. The practitioner is not a NYSED-certified “Certified Dietitian,” or “Licensed Dietitian-Nutritionist,” and does not present or practice as such.
b. No Medical Services Provided
The Company does not provide: medical diagnosis, medical nutrition therapy as defined by New York State law, treatment for disease, prescription or management of medications, or emergency care. All nutrition, lifestyle, and functional health recommendations are intended for general wellness and educational purposes only.
c. Consult Your Healthcare Provider
You agree to consult your physician or licensed healthcare provider before: beginning any nutrition or exercise program, changing medications, implementing supplement recommendations, or addressing chronic or acute medical concerns. You understand that Nutritionally Well’s Services are not a substitute for professional medical care.

4. INTELLECTUAL PROPERTY
a. Ownership
All content and materials associated with the Services, including but not limited to written content, graphics, illustrations, downloads, program materials, branding, and design elements, are the exclusive property of AML Fit LLC d/b/a Nutritionally Well. You may not reproduce, distribute, share, modify, or create derivative works from this content without prior written permission.

b. User Content
Any content you voluntarily submit (feedback, testimonials, comments, etc.) remains your intellectual property. However, by submitting content, you grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, display, or distribute such content for business or promotional purposes.

5. PRIVACY
a. Privacy Policy
Your use of the Services is also governed by the Company’s Privacy Policy, which outlines how personal information is collected, used, stored, and protected. By using the Services, you consent to the handling of your personal information as described in that policy. Please note that while the Company upholds strict confidentiality standards, AML Fit LLC may not be considered a HIPAA-covered entity.

6. LIMITATION OF LIABILITY
a. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. The Company makes no warranties, express or implied, regarding: accuracy, fitness for a particular purpose, expected outcomes, non-infringement, availability or reliability of the Services.
b. Limitation of Liability
To the fullest extent allowed by law, the Company shall not be liable for any: direct, indirect, incidental, or consequential damages, loss of data, profits, business, or personal well-being, adverse reactions, outcomes, or interpretations of recommendations. Your use of the Services is voluntary and at your own risk.

7. GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from these Terms or the use of the Services will be handled exclusively in the courts located within New York State.

8. MISCELLANEOUS
a. Entire Agreement
These Terms reflect the entire agreement between you and the Company and supersede any prior agreements or understandings regarding the Services.
b. Severability
If any provision is deemed invalid or unenforceable, the remaining provisions shall continue in full effect.
c. Waiver
Failure of the Company to enforce any right or provision within these Terms does not constitute a waiver of such rights.
